Términos y Condiciones

  1. Alcance del Proyecto El proyecto se llevará a cabo de acuerdo con las especificaciones y requisitos establecidos por el cliente y el fotógrafo. Cualquier cambio o desviación de los requisitos establecidos requerirá la aprobación explícita y por escrito del cliente.

  2. Plazos de Entrega El fotógrafo se compromete a cumplir los plazos de entrega acordados con el cliente. Sin embargo, el fotógrafo no se hace responsable de los retrasos causados por factores externos no controlables, como el clima. Cualquier modificación solicitada por el cliente debe ser comunicada dentro del plazo establecido.

  3. Responsabilidad Legal El fotógrafo se compromete a cumplir con todas las leyes y regulaciones aplicables en la realización del proyecto. El cliente será responsable de obtener cualquier permiso o autorización necesaria para la realización del proyecto.

  4. Derechos de Imagen El cliente otorga al fotógrafo el permiso para utilizar las imágenes generadas en el proyecto para su propia promoción de productos. El cliente y el fotógrafo son propietarios del contenido generado durante la realización del proyecto. El cliente podrá utilizar el contenido generado exclusivamente para fines relacionados con el proyecto en cuestión. Cualquier uso posterior del contenido generado, incluyendo pero no limitado a la publicación, modificación o distribución, requerirá el permiso explícito y por escrito del fotógrafo.

  5. Precio y Pagos El precio y la forma de pago se establecerán de mutuo acuerdo entre el cliente y el fotógrafo. El cliente se compromete a pagar el precio acordado en el plazo establecido. En caso de retraso en el pago, el fotógrafo se reserva el derecho de detener la entrega del proyecto y/o tomar las medidas legales necesarias para recuperar el pago adeudado.

  6. Terminación del Proyecto Cualquiera de las partes podrá rescindir el proyecto en cualquier momento si la otra parte incumple de manera sustancial las obligaciones establecidas en este contrato. En caso de rescisión, el cliente se compromete a pagar por los servicios prestados hasta la fecha de rescisión.

  7. Ley Aplicable y Jurisdicción Este contrato se regirá e interpretará de acuerdo con las leyes de España. Cualquier controversia que surja en relación con este contrato se someterá a la jurisdicción exclusiva de los tribunales de España.

However, please note that we may charge a cancellation fee if you cancel a booking without sufficient notice.

    5. Intellectual Property We retain the intellectual property rights in the photographs and videos we create. However, we grant you a limited license to use the photographs and videos for the purpose of promoting your business in connection with the project for which we were hired. You may not use the photographs and videos for any other purpose without our prior written consent.

    6. Limitation of Liability We take great care in providing our services, but we cannot guarantee that our services will be free from errors or interruptions. We are not liable for any loss or damage arising from the use of our services, except where such loss or damage is caused by our negligence.

    7. Indemnification You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of our services, your breach of these Terms, or your violation of any law or the rights of any third party.

    8. Governing Law These Terms are governed by and construed in accordance with the laws of Spain. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Spanish courts.
